Case 004

Summary:

On 7 September 2009, the international Co-Prosecutor filed two Introductory Submissions, requesting the Co- Investigating Judges to initiate an investigation of five additional suspected persons. These two submissions have been divided into what is known as Case files 003 and 004.

Although not officially publicised by the ECCC, it has been widely reported in local and international news that Case 004 involves former mid-level Khmer Rouge commanders Im Chaem, Ta Ann and Ta Tith. Chaem allegedly ran a forced labor camp involving a massive irrigation project in Preah Net Preah.  Ta Ann and Ta Tith were two deputies who allegedly oversaw massacres in the camp.

Press releases issued by defence lawyers MOM Luch, Richard ROGERS and Goran SLUITER on 21 February 2013 regarding the rights of suspected persons in case 004 suggest that at least one suspect in case 004 has legal representation.

Controversy has surrounded both Cases 003 and 004, with several split-decisions of the Pre-Trial Chamber along international and national lines and numerous allegations of political interference.
